The Plaintiff in this matter, an elderly lady, receiving respite care at her local public nursing home, and during the course of her being transferred from her bed to a chair by the use of a hoist, the Plaintiff fell from the hoist and sustained very serious injuries.

McElhinney & Associates Solicitors secured expert reports from nursing consultants and engineers reports into the defective hoist. It was found that the latches on the hoist were defective and secondly that wires were in the path of the hoist which should have been moved prior to the commencement of the maneuverer.

Proceedings were issued by McElhinney & Associates against the HSE. The HSE invited the Plaintiff and her legal advisors to settlement negotiations and the case were ultimately resolved with a substantial settlement for Plaintiff.
