At McElhinney & Associates Solicitors, we recently represented a young mother who suffered a post-partum haemorrhage following a C-Section.

Following her return to the maternity ward, she suffered shoulder tip pain, increased pain in her upper abdomen and was unable to move. It wasn’t until approximately 24 hours following delivery that a significant drop in haemoglobin alerted the doctors to the patient’s deteriorating medical state.

The patient then underwent a laparotomy and it was found that two vessels were bleeding in the uterine incision and they were secured. The patient required a significant amount of blood and had to undergo additional surgery and underwent significant psychological trauma.

We obtained expert evidence that one bleeding blood vessel is a known risk of Caesarean Section, however, two bleeding blood vessels are evidence of poor surgical technique and substandard care.

The HSE initially denied liability, however late in the day they accepted that there was a breach of duty in the care provided to our client, but did not accept that they were responsible for all of the adverse consequences that flowed from that breach of duty.

Ultimately, on the eve of trial, the case settled for a significant sum.
